Action Charters – Bookings and Reservations Terms and Conditions


Terms and Conditions of booking your Action Charters trip.

General Conditions

The prices and details appearing on our website, relevant e-mails, faxes, correspondence and replies, are provided and coordinated by Action Charters Pty Ltd.

Action Charters Pty Ltd has taken due care and responsibility to verify and check all information on our web site as at time of completion, however, it accepts no responsibility for any inaccuracies.

Action Charters Pty Ltd does not accept any liability of whatever nature for acts, omissions or default, whether negligent or otherwise in connection with any bookings. We do not accept liability in contract or tort for any injury, damage, loss, delay, additional expense or inconvenience caused directly or indirectly by force majeure or other events which are beyond our control.

Rates and Prices

All rates and prices are however subject to change without notice and become fixed and firm only once deposit for the booking is paid and funds cleared.

All costs are shown in Australian Dollars unless otherwise specified.

Rates and Prices provided by Action Charters are for booking and paying for the fishing charter portion of your trip only. We do not have capacity to provide assistance with accommodation and travel whilst on land unless airport transfers are requested and agreed prior to arrival.

Quotations

All quotations are subject to availability of services quoted and are not guaranteed until the booking is confirmed and a deposit received.

Deposits and Confirmations

A minimum deposit amount (specified at the time of booking enquiry) is required within 7 days of confirmation of the booking. Final payment must be made 30 days prior to travel and with bookings made less than 7 days prior to travel, final payment must be made within 48 hours of confirmation.

Payments

Payments can be made by direct deposit into Action Charters account and details of payment confirmation may be advised via remittance advice sent to info@actioncharters.com.au. By prior arrangements funds may also be paid with cash provided in person. We do not have credit card payment facilities.

Cancellations

Must be by email (info@actioncharters.com.au), No cancellations will be accepted unless received in writing.

Standard Cancellation Policy: In the majority of cases, if you cancel or terminate your booking 30 days or more prior to commencement of your holiday / tour no cancellation fee applies. If cancelled between 30 days and 15 days prior to departure a fee of 10% of booking will apply. If cancelled between 14 & 7 days prior to departure a 25% cancellation fee will apply. All bookings cancelled inside 7 days incur cancellation fees of 50% monies paid.

The amount of cancellation fees charged will be deducted from any monies received before a refund is made. We strongly recommend you purchase travel insurance.

Unless advised by Action Charters after booking and paying for the trip it is going ahead. If the weather suitable to proceed with the trip we will not call to advise the trip is going ahead, we expect you will be at the departure point advised in your booking confirmation email.

If there weather is unsuitable for the charter to proceed we will contact you as soon as practicable and we will advise wether changes or cancellation are required. Action Charters will always endeavour to advise our clients of these matters as early as possible however at times the call will be made the night before or even on the morning of the trip.

If the trip is cancelled by Action Charters you will be given the option to shift the deposit to a new suitable booking date or to have the deposit refunded in full 100% If the day is marked as a mixed charter where we are filling multiple spots on the boat in most cases we will fill the whole boat, so expect the trip to be going ahead. However if all the seats are not filled Action Charters reserve the right to cancel the trip, in which case your deposit will be refunded in full.

Changes to Trip plans / destinations

Itineraries: Due to the nature of sea travel and fishing charters Action Charters reserves the right to alter itineraries at any time as a result of weather conditions or any other circumstance beyond their control.

Refunds: No refunds will be made for availed services once charter has commenced. Any refund claim will be subject to a minimum of $50 per booking processing fee. No guarantee is provided or warranted that any refund will be available. All refund requests must be in writing, and made direct to Action Charters. Claims must be made within 30 days of completion of travel arrangements.

Tackle

Fishing tackle and hardware is provided on a "replace if lost / damaged / broken basis".

If you have got your own gear - great! Bring it along however we do not accept any responsibility in the event your own equipment is lost or damaged.

On certain extra ordinary charter trips Action Charters may require clients to provide their own tackle (or part thereof) and this will be advised to you at the time.

Replacement hardware and tackle is charged as follows:

Hooks, Sinkers, Leader - no charge
Jigs $20
Hard Body Lures $25
Rods $350
Complete rod/reel package $750

Safety

While we do our upmost to ensure passenger safety, by booking you acknowledge that by nature this trip can be both physically and mentally strenuous and inherently involves a number of risks. Action Charters will not be held liable for any accident, injury or other which occurs during your time with Action Charters.
Your skipper will give you a safety briefing on the morning of boarding the boat for the first time. Please ensure you listen to the briefing and if anything you are unsure of please is notify the skipper.
By booking this trip you agree to follow any of the skipper’s safety orders on the day.

Food, Drinks and Alcohol

Action Charters will supply all food, water and some soft / fizzy drinks. Alcoholic drinks and any specific mixers are not supplied by Action Charters however we do have the necessary fridge space to keep your drinks cold should you wish to bring them.
Should we feel alcoholic drinks are not being consumed responsibly, we reserve the right to ask people to refrain from drinking on board.

If you or any of your charter group suffer from any allergies we request you advise us at time of booking so that we can take care in ensuring we cater accordingly for the trip.
